Terms of Service

These Terms of Service ('Terms') are a binding agreement between you and PrintScale, a United States–based service ('PrintScale', 'we', 'us'). By creating an account, purchasing credits, or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility and acceptance

  • You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract.
  • If you use PrintScale on behalf of a company or other organization, you represent that you are authorized to bind that entity to these Terms, and 'you' includes that entity.
  • By accessing or using the service you accept these Terms, the Privacy Policy, and the Acceptable Use Policy, which are incorporated by reference.

2. The service

PrintScale lets you upload supported image files, spend prepaid credits, and generate upscaled, print-oriented TIFF outputs using automated AI image-processing models. The service is provided on an 'as available' basis and may evolve, change, or be discontinued in whole or in part at any time.

3. Accounts

  • You are responsible for all activity under your account and for keeping your credentials secure.
  • You must provide accurate information and only use accounts you are authorized to access.
  • Notify us promptly at hello@printscale.app if you suspect unauthorized use of your account.

4. Credits, pricing and payments

  • Access is sold as prepaid credit packs. Credits are spent per successful upscale; the number of credits depends on the output size (typically 1, and 2–3 for larger prints), shown before you confirm each job.
  • Payments are processed by our third-party payment processor (Stripe). By purchasing, you authorize the applicable charge, including any taxes, and you agree to the processor's terms.
  • Prices, pack sizes, included credits, and applicable taxes are those shown at checkout and may change prospectively. Changes do not affect credits you have already purchased.
  • Credits have no cash value, cannot be exchanged for money, transferred, or combined across accounts, and are licenses to use the service rather than stored funds.

5. Refunds and cancellations

  • Credits deliver a digital service that is made available immediately, so purchased credits are non-refundable except where these Terms or mandatory law require otherwise.
  • If a job fails for reasons attributable to the service, the consumed credit is automatically returned to your balance; that automatic re-credit is your sole remedy for a failed job.
  • We do not provide refunds for outputs you dislike, for results that are unsuitable for a particular print process or use, or for credits unused before account closure.
  • Nothing in this section limits any non-waivable statutory refund or withdrawal rights you may have as a consumer in your jurisdiction.

6. Chargebacks and payment disputes

If you believe a charge is incorrect, contact hello@printscale.app first so we can resolve it. Initiating a chargeback or payment dispute without contacting us, or disputing charges for credits that were delivered or consumed, is a breach of these Terms. We may suspend or terminate accounts associated with abusive disputes, revoke affected credits and outputs, and recover amounts owed, including reasonable processing and collection costs permitted by law.

7. Your content and the rights you grant

  • You retain ownership of the images you upload ('Input') and of the outputs generated from them ('Output'), subject to any third-party rights.
  • You grant PrintScale and its processors a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and adapt your Input and Output solely to operate, secure, and provide the service to you, and as needed to comply with law.
  • You represent and warrant that you own or have all rights, licenses, consents, and releases necessary to upload and process the Input and to use the Output, including any rights in third-party works, trademarks, logos, and the likeness of any identifiable person.
  • You are solely responsible for your Input and Output and for how you use them.

8. AI-generated outputs

  • Outputs are produced by automated machine-learning models and may contain artifacts, inaccuracies, hallucinated detail, or unexpected changes.
  • We make no representation that Outputs are original, accurate, non-infringing, eligible for copyright or other protection, or fit for any particular purpose.
  • AI Outputs may not be protectable as your intellectual property in some jurisdictions, and similar Outputs may be generated for other users.
  • You are responsible for independently reviewing, proofing, and verifying every Output before printing, distributing, or delivering it to clients.

9. Print, color and production disclaimer

PrintScale is an upscaling tool, not a print, color-management, or pre-press service. We do not guarantee that any Output will be suitable for a given printer, substrate, resolution, color profile, ICC workflow, proofing standard, or commercial print run. You assume all responsibility and cost for test prints, proofing, and production decisions.

10. Acceptable use

You must comply with the Acceptable Use Policy, which prohibits illegal content, infringement, abuse of the service, and harmful or deceptive uses. We may remove content, block jobs, and suspend accounts to enforce it.

11. File retention is not a backup

Inputs, previews, and Outputs are retained only for the limited period described in our File Retention policy (currently 3 days) and are deleted afterward. PrintScale is not a storage or backup service. You are responsible for downloading and archiving production files before they expire.

12. PrintScale intellectual property

The service, software, models, interfaces, and the PrintScale name and branding are owned by PrintScale or its licensors and are protected by law. These Terms grant you no rights in them except the limited right to use the service in accordance with these Terms.

13. Copyright complaints and takedown

We respect intellectual property rights. If you believe content processed through the service infringes your copyright, send a notice to hello@printscale.app including: identification of the work, the specific material and where it appears, your contact details, a statement of good-faith belief that the use is unauthorized, a statement that the information is accurate, and your physical or electronic signature. We may remove or disable access to allegedly infringing content and may terminate accounts of repeat infringers.

14. Service availability and changes

The service is provided on an 'as is' and 'as available' basis. We do not guarantee uninterrupted, secure, or error-free operation, any specific processing time, or any uptime level. We may modify, suspend, limit, or discontinue features at any time.

15. Suspension and termination

  • We may suspend or terminate your access for breach of these Terms, suspected fraud or abuse, security risk, non-payment or chargeback abuse, or where required by law.
  • You may stop using the service at any time and may delete your account from the account settings.
  • On termination, your license to use the service ends and unused credits are forfeited, except where mandatory law provides otherwise. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and governing law) survive termination.

16. Disclaimer of warranties

To the maximum extent permitted by law, the service, credits, and Outputs are provided without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and availability. Some jurisdictions do not allow the exclusion of certain warranties, so some exclusions may not apply to you.

17. Limitation of liability

  • To the maximum extent permitted by law, PrintScale and its suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, reprint or production costs, or business interruption, even if advised of the possibility.
  • Our total aggregate liability arising out of or relating to the service or these Terms will not exceed the greater of (a) the total amounts you paid to PrintScale in the twelve (12) months before the event giving rise to the claim, or (b) USD 100.
  • These limitations apply to all claims, whether based in contract, tort, statute, or otherwise. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you, and nothing here limits liability that cannot be limited by law.

18. Indemnification

You agree to defend, indemnify, and hold harmless PrintScale and its officers, employees, and suppliers from any claims, damages, liabilities, and reasonable costs and legal fees arising from your Input or Output, your use of the service, your violation of these Terms or applicable law, or your infringement of any third-party rights.

19. Third-party services

The service relies on third parties such as Stripe (payments), fal.ai (image processing), Supabase (database and authentication), Cloudflare R2 (storage), and Vercel (hosting). Their services are governed by their own terms, and we are not responsible for their acts, omissions, availability, or content.

20. Changes to these Terms

We may update these Terms from time to time. The 'Last updated' date reflects the current version. For material changes we will take reasonable steps to notify you. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.

21. Governing law, arbitration and class-action waiver

  • These Terms and any dispute relating to them are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-laws rules.
  • Informal resolution first: before starting any proceeding, you agree to contact hello@printscale.app and try in good faith to resolve the matter informally for at least 30 days.
  • Binding arbitration: if the dispute is not resolved, it will be settled by final and binding individual arbitration administered under the rules of a recognized U.S. arbitration provider, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section.
  • Class-action waiver: disputes will be brought only in your individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding.
  • Exceptions: either party may bring an individual claim in small-claims court, and either party may seek injunctive or equitable relief in court to protect its intellectual property or stop misuse of the service.
  • Consumer rights and opt-out: nothing here removes mandatory rights or forums available to you as a consumer under the law of your place of residence, and you may opt out of arbitration by emailing hello@printscale.app within 30 days of first accepting these Terms.

22. Miscellaneous

  • These Terms, the Privacy Policy, and the Acceptable Use Policy are the entire agreement between you and PrintScale regarding the service.
  • If any provision is found unenforceable, the rest remains in effect and the provision is enforced to the maximum extent permitted.
  • Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
  • We are not liable for delays or failures caused by events beyond our reasonable control.
